Introduction

Rodmar ITC (“My Resto Supply” “us,” “we,” “our”) operates a network of websites and a mobile application serving multiple cities in the United States. By visiting our website, using our mobile app, and accessing the information, resources, services, products, and tools we provide (the “Services”), you understand and agree to accept and adhere to these Terms of Service (these “Terms”), and acknowledge and agree to the practices described in our Privacy Policy.

Section 1. Modification of Terms

We reserve the right to change the Terms from time to time without notice to you. Any changes to these Terms will be posted on the Services, and we will notify you as required by applicable law. You acknowledge and agree that it is your responsibility to review these Terms periodically to familiarize yourself with any modifications.

Section 2. Account Creation and Eligibility

• Account Creation: To make purchases, you must create an account with us. You must provide current, complete, and accurate information.
• Account Security: You are responsible for selecting a secure password and maintaining the confidentiality of your account. My Resto Supply is not liable for any loss incurred as a result of someone else using your password.
• Account Eligibility: You are prohibited from creating an account unless you are at least 18 years old.
• Account Suspension: We reserve the right to suspend, restrict, or terminate your access to the Services if we reasonably suspect fraudulent activity or breach of these Terms.

Section 3. Orders and Payments

• Orders: Orders must be confirmed before the cutoff time. Available delivery dates and fees will be shown during the ordering process.
• Modify Order: If your order is in the “preparing” status, you can modify it via “My Orders”. After the cut-off time, the order cannot be modified.
• Payments: Payments may be made through authorized payment methods. We reserve the right to cancel orders with suspicious payment methods.
• Price & Availability: Prices may change at any time prior to purchase. In the event of supply chain disruptions, we will issue a refund for unavailable items.

Section 4. Acceptable Use

You agree to use these Services only for intended purposes. You will not engage in "Prohibited Uses" including but not limited to:

• Making available malicious computer code or viruses.
• Using the Services for fraudulent or unlawful purposes.
• Abusing the Services through excessive returns and/or refunds.
• Harvesting or collecting information about other users.
• Interfering with the operation of our servers or networks.
• Reverse engineering or reproducing our Services without authorization.

Section 8. General Delivery (Non Mail-Order)

We do not require your presence for delivery of non-alcoholic products. We will deliver to the address you designate. If we are unable to deliver your package due to missing access codes or unsafe drop-off places, we will attempt to contact you. In the event you input the wrong address and we successfully deliver to that address, you are responsible for that shipment without refund. We do our best to keep perishable products at recommended temperature thresholds.

Section 22. Disclaimers

The Services, and all products, functionality, and other items made available to you are provided by My Resto Supply on an "As Is" and "As Available" basis. My Resto Supply disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. You assume full responsibility for your use of the Services.

Section 25. Disputes, Arbitration, & Class Action Waiver

Any dispute, claim or controversy arising out of or relating to the Services shall be resolved by binding arbitration or in small claims court. Arbitration uses a neutral arbitrator instead of a judge or jury. You and My Resto Supply agree to bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
